İLƏTİŞMƏ 2 – SON-DURUM 1: CƏNAB LƏYSANLININ İRANDA İNSAN HAQLARININ TAPDANMASI

Cənab Abbas Leysanlının insan haqlarını qorumaq üçün İlətişmə 2 (Say: 489/2008 Tarix: 25 May 2008) üzərində Son-durum 1-i hüzurlarınıza sunuruq. Sunulan bilgilər bunlara şamildir:

· Cədvəl 1 cənab Leysanlının qatlaşdığı qəzov-qədəri Genəl İlətişmə 1-dən bəri (Say: 490/2008; Tarix 27 May 2008) icmal edir ki, İran yetgililərinin tərəfindən ona qıyılır.

· Cəvəl 2 ona qarşı yürüdülən öz-xoşuna məhkəmə qovluqlarını bir daha xatırladır.

· Cədvəl 3 Məhkəmə Dosye 4-ün buraxdığı hökmü icmal edir.

İlətişmə sunmaqda ləngiməmiz bir az uzun sürməsinə görə, Yanvar 2008-dən bəri bir durum qeydi (Say: 494/2008 Tarix: 10 İyun 2008) təqdim etdik. Demək, Yanvar 2008-dən bəri İran yetgililəri Güney Azərbaycanlıların milli və insan haqlarına qarşı tapdamaqda basqınçılıq etmə həddinə çatdırmışlar. Durum qeydi gedən basqının dərinliyini göstərmək niyyətində deyil idi, və buna görə çatdıracağımız İran yetgililərinin amansızlıqları barədə bilgiləri yetərincə toplayıb və hüzurlarınıza təqdim edəcəyik. Genəl İlətişmədən (Say: 485/2008 Tarix: 28 Yanvar 2008) indiyə dək başlıca durum belədir ki, yüzlərcə insan öz-xoşuna tutuqlanmağa məruz qalmışlar və eləcə də iki fərd də qanun-dışı qəltə məruz qalmışlar.

Cənab Leysanlının insan haqlarının dirçəldilməsi uğrunda aparılan geniş kampaniyalara baxmayaraq, İran yetgililəri hələ də inada qapınmışlar, onun insan haqlarını tapdamaqda heç bir şeydən çəkinmirlər və nəticə də belədir:

· Onu ardıcıl tutuqlu saxlamaqdadırlar,

· Onu ardıcıl surətdə qeyri-qanuni olaraq Güney Azərbaycandan sürgün etmişlər,

· Ona ailəsi ilə görüş haqqını qeyri-qanuni olaraq inkar etmişlər, və

· Müstəmləkəçi əhval-ruhiyyə ilə İran yetgililəri onu bilinməyən səbəblərə görə təcrid etmişlər.

Diqqətinizə çatdırmaq istərdik ki, bu Son-durum Leysanlı bəyin ailəsi ilə əlaqə qurmadan bizim öz təşəbbüsümüz ilə hazırlanıbdır. İran yetgililərinin basqı riskini azaltmaq üçün bu ifadəni verməliyik. Hər halda aydındır ki, onun insan və milli haqlarını qorumaq üçün sizin öhdəliyinizdə olan mandatlar gələ bilər və arxayınıq ki, bu baxımdan hər gərəkən addımı atacaqsınız.

COMMUNICATION 2 – Update 1: IRANIAN VIOLATIONS OF MR. LEYSANLI’S HUMAN RIGHTS

Please find enclosed Update 1 to Communication 2 (Ref: 489/2008 on 25 May 2008) for safeguarding national and human rights of Mr. Abbas Leysanli. The information submitted comprises:

· Table 1 outlines the ordeal suffered by Mr. Leysanli since our General Communication 1 (ref: 490/2008 on 27 May 2008) inflicted by the Iranian authorities against him.

· Table 2 reminds you with the arbitrary court cases.

· Table 3 outlines the outcome of Court Case 4.

Owing to a rather long lapse in the submission of our communications, an outline of the situation since January 2008 is outlined. The general background since January 2008 is that is the Iranian authorities have been waging massive offensives against the national and human rights of Southern Azerbaijanis. As our Briefing Note (Ref: 494/2008 on 10 June 2008) was not a sufficient reflection of the ongoing situation, we therefore have a massive backlog and endeavour to keep you informed on the violation of human rights since our General Communication1 (Ref: 485/2008 on 28 January 2008). The situation since then is that since then hundreds have been arbitrarily detained and at least two innocent individuals were victims of extra-judicial killings.

In spite of a massive campaign for the reinstatement of human rights of Mr. Leysanli, the Iranian authorities have remained obstinate in their aggression against his human rights and the outcomes include:

· A continued illegal detention of him,

· A continued illegal deportation of him from Southern Azerbaijan ,

· A continued denial of the right of access to him to visit his families, and

· A complete isolation of Mr. Leysanli by colonially-minded Iranian authorities for unexplained reasons.

We would like to stress that this update is submitted under our own initiative without consulting with Mr. Leysanli’s family members. We state this to manage reprisal risks by Iranian authorities against them. Evidently the only instrument for the defence of Mr Leysanli human and national rights is the mandate entrusted on you and we are confident that you will take every steps to exercise your mandates.

Table 1: Outline of Events Inflicted against the Leysanli Family Since March 2008

Since March 2008, the following has been taking place:

· The Azerbaijani Diaspora has rallied for an international support to Mr. Leysanli in March, April and May including demonstrations in the various cities of democratic countries and reports from Voice of America and the BBC.

· According to a report (http://www.lisani.blogfa.com/) the Leysanli family has been threatened by a judge in Erdebil that the Leysanli family must migrate to a Farsi-speaking city, else he will be arrested after any protests in Erdebil and Azerbaijani cities.

· The family house of Mr. Leysanli is under a continual surveillance.

· His family has been unable to visit him since their only visit in April due to the illegal deportation of Mr. Leysanli from a prison in a Southern Azerbaijani city of Eher to the remote Yazd prison in a Farsi-speaking city. We have presented the argument by Mr. Leysanli’s lawyer that the act of deportation by the Iranian authorities was illegal (see Table 5 of Communication2, Ref: 489/2008 on 25 May 2008).

Abbas Leysanli was sentenced to a cash fine

Monday 7 April 2008

Branch 113 of the Court for Carrying out Sentences passed the sentence of cash fining to Abbas Leysanli, cultural activist and a prisoner of science of (Southern) Azerbaijan .

The Judge named “Jesur” reviewed the case and referring to the defence of Abbas Leysanli and the other contents of the file determined the fine to 50,000 Tumen.

The charge against Leysanli was undermining general peace.

This court case was related to his attendance on the anniversary of Baghirkhan marked at the Baghirkhan mausoleum on 5 August 2005.

عباس لسانی به پرداخت جزای نقدی محکوم شد

ساوالان سسی: شعبه 113دادگاه اجرای احکام تبریز، عباس لسانی،فعال مدنی و زندانی سیاسی آذربایجانی،را به پرداخت جزای نقدی محکوم کرد.

قاضی جسور پس از رسيدگی به اين پرونده، عباس لسانی را با استناد به محتويات پرونده و دفاعيات وکيل مدافع وی به ۵۰,۰۰۰ تومان جزای نقدی محکوم کرد.

اتهامات لسانی در اين پرونده «اخلال در امنیت عمومی»، عنوان شده است.

موضوع اين پرونده مربوط به حضور وی بر مزار باقرخان در تاریخ ۱۴ مرداد ماه سال ۱۳۸۴ در تبریز است.
