Abbas Leysanlı bəy, Güney Azərbaycanın milli
hərəkətinin adlı- sanlı başçılarından
biri, İran İslam Respublikası tərəfindən
yenidən öz-xoşuna yaxalanıb qazamata salınmışdır.
Həmişəkindən daha artıq, bu öz-xoşuna inadcıl
əməl bir simgə diyə, İran yetgililərinin Güney
Azərbaycanın insan haqlarına basqınçılıq
etmələrini aşkara çıxardır. İndicə, dünya
insan haqlarını savunanlara bu epizodda həmrəylik ifadə
etmək üçün bir sınaq meydanı ortaya çıxır. Bu dustağa
məruz qalma barədə özəl verilənləri və
gərəkən zəmin bilgini qarşınızda təqdim
edirik. Leysanlı bəyin insan haqlarını qorumaq üçün
Şikayətimiz cərəyanda və bu vasitə ilə son
durumu təqdim edirik.

UPDATE ON A COMPLAINT: THE REARREST OF MR. LEYSANLI
Now
Mr. Abbas LEYSANLI, the most distinguished leader of the national movement of
The
information provided as part of this update is as follows:
We
confirm that Mr. Leysanli is deprived of his liberty and provide you the
appropriate details. There remains the question that why Mr. Leysanli was
imprisoned? Our response is that he has not broken any law and he is just
exercising his human rights. Thus, Mr. Leysanlis detention and imprisonment
are illegal. We lay down some of the possible reasons for his re-arrest:
In
particular, we would like to draw your attention into the following evidences
for arbitrary way of functioning of the authorities:
We
believe that Mr. Leysanlis appeal was not conducted in a fair manner but it
looks that the determination was premeditated and without reference to the
documents and evidences. However, we do not have the full information yet. We
will provide you an update as soon as the appropriate information becomes
available.
Hereby,
we reinforce our Complaint lodged earlier with further evidence for safeguarding
human rights of Mr. Abbas Leysanli. Lack of sufficient information should not be
a pretext your inaction, against which we pledge our readiness to provide you
any information as and when required. We trust that you will act on this
Complaint and hope that you share the concern of the nation of Southern
Azerbaijan and are preparing for a country visit to explore for yourselves the
violations of human rights of Mr. Leysanli in Erdebil, and other activists, such
as maestro Hesen

Mrs.
Leysanli: Abbas was taken away at 2.00 p.m. by plain-close security
agents, on 31 October 2006, who were using two vehicles: a taxi and a
private car of the ARDI make. While being taken away, he called me
informing of the situation. I dashed to his workplace but he was already
taken away. Approximately at 4 Oclock Abbas called me from the prison
saying that now I am being transferred into the prison for carrying out
the recent the sentence of 16 months of imprisonment and of flogging with
50 lashes. According
to the reporter on behalf of Mrs. Leysanli: the sentence of the
imprisonment is illegal, as his appeal for the sentences passed both in
September and October are yet to reviewed. Without the verdict from the
appeal court it is illegal to carry out the sentence. Mrs.
Leysanli: Mr. Feqihi (Mr. Leysanlis lawyer) came last week regarding
the finalisation and submission of the appeal. There is no response yet on
the appeal and carrying out the sentence with the verdict of the appeal
court is illegal. According
to the reporter: Mr. Leysanli was detained illegally for 4 months and when
released, he was required to meet with the Imam of Erdebil. However, Mr.
Leysanli was not minded on this requirement. Mr. Leysanlis lawyer has
been informed of the imprisonment and he will object to it. |

Mr
Abas Lisani was re-arrested (31st October 2006) and his
sentence increased from 16 moths to 18 months The Mehemmedrza
Feqihi, the lawyer defending Mr. Leysanli expressed his surprise to the
reporter of ILNA (the Iranian Labour News Agency) regarding this appeal
outcome and stated that after the issuance of 16 months of punitive
sentence and 50 lashes to my client by the Penal Court of Erdebil, Branch
105, we lodged our appeal and this together with our file was sent to the
Appeal Court of Erdebil. The Appeal Court of Erdebil accepted a
recommendation from the Prosecutor of the General and He
added that Sub-clause 3 of Article 22 of the Legislative General and
Revolutionary Courts expressly states in relation to the powers conferred
to the Prosecutor that if an individual is sentenced, the higher courts
cannot increase the sentence, unless requested by the Prosecutor or the
private plaintiff. In reality, the Mr.
Leysanlis lawyer continued saying that the Prosecutor of Erdebil
referred to Article 19 of the Islamic Penal Codes and increased the
sentence on my client from 10 to 12 months of imprisonment (the total was
16 months and increased to 18 months) and retained the 50 lashes and wants
the verdict to be carried out in full. The Feqihi
added that this verdict is unprecedented in the judiciary history of
the Islamic Republic of Iran, or at least I am unaware of such a case.
