Tutuqlanmış Güney Azərbaycanlı dörd yeniyetmələri qorumaq üçün 2 Oxtobr 2006-da (Müraciət: 393/2006) hüzurlarınıza təqdim etdiyimiz şikayətə dair bu son gəlişməni təqdim edirik. Bu dörd yeniyetmə neşə gün öncə  buraxıldılar. Bunun üçün Amnesty International qurumundan apardıqları kampaniyaya (MDE 13/118/2006, Tarix: 11 Oxtobr 2006) görə minnətdarıq. Bu barədə sizin də ehtimalı rolunuza görə təşəkkür edirik, nə isə məhrəmanə iş apardığınız üçün işlərinizin nəticəsindən xəbərsizik. Hər halda aşağıdakı açıqlamalar üçün şikayətimiz hələ də davam edir.

 

Bu son gəlişmə vasitəsi ilə 15 yaşlı oğlan uşağı, Məhəmməd Rza Əvəzpurun, dosyesini diqqətinizə çatdırmaq istəyirik. Bu yeniyetmənin buraxılmasından bəri bəllənib ki, Şikayətimizdə üşəndiyimiz kimi, bu tifil bala tutuqlu ikən sarsıntıya məruz qalmışdır və indi də pis-yuxu görməkdən əzab çəkir. Onun Amerika Səsi Radiosuna verdiyi müsahibəni Cədvəl 1-də tərcümə etmişik ki bu faktları aşkara çıxardır. Bunların məruz qaldıqları duruma saldıqda bəllənir ki, Araşdırma Təmsilçinizi xahiş etməmiz heç də yersiz deyilmiş və bu yeniyetmələrin sarsınmalarını önləyə bilərmiş. İndi isə, yetgililər Məhəmməd Rzanın eyitməsinə əngəl törətmə tədbirinə can atmışlar və indi onu heç bir məktəb qəbul etmir. Onun ailəsi çarəsizliyə çataraq söyləyir ki, daha bilmirik ki, şikayətimizi kimə çatdıraq. İnanırıq ki, bu şəraitdə bu baxımdan gərəkən yetgisi olan qurum sizin qabil idarənizdir və özəl mandatınız var ki bu yeniyetmənin eyitməsi üzrə insan haqlarını sağlaya bilərsiniz.

 

Şikayətimizi təqdim edəndən sonra tutuqlulara görə ixtiyarımızda olan bilgilərə yenidən baxanda bəlli oldu ki, ən azı bir başqa Güney Azərbaycanlı tutuqlu yeniyetmənin dosyesini gərəyincə vurğulamamışıq. Onun adı Bəhruz Əlizadədir və ona aid bilgi Cədvəl 2-də təqdim olunur və bu bilgilərin qaynaqları İnternetdır. Onun adı keçmiş məktublarımızda qeydə alınmışdı, misal üçün: 391/2006, Tarix 29 Septambr 2006; 382/2006, Tarix 17 Septambr 2006; və 344/2006, Tarix 28 İyun 2006. Bu Cədvəl göstərir ki, o yetgililər tərəfindən 6 ayda üç dəfə öz-xoşuna tutuqlanmış və onun insan haqlarının tapdanması iftizah dərəcəsinə gəlib çatmışdır. İndi də o Ədəbil Zindanında cinayətçilər içində saxlandığı üçün onun sağlamlığından ötəri biz olduqca nigaranıq. Qazı Əlaı bəyin bəyanatı hər bir şeyi aşkara çıxardır, necə ki o bu gəncə “cari subyekt gözündə baxır və istədiyimiz vaxtda sizləri yaxalaya bilərik” demişdir, bax Cədvəl 2-yə. Bu vasitə ilə onun həmən və şərtsiz buraxılması uğrunda diqqət etmənizi xahiş edirik.

Güney Azərbaycanın bu yeniyetmələri barədə insan haqlarının tapdanmaları ucundan şikayətimizə son gəlişmələri hüzurlarınıza çatdırıb və şikayətimiz davam edir. Bu yeniyetmələrin insan haqlarının qaytarılması üçün aparacağınız ehtimali tədbirlərinizə qabaqcadan təşəkkür edirik.

Re       UPDATE ON COMPLAINT FOR PROTECTING SOUTHERN AZERBAIJANI TEENAGERS DETAINED BY IRANIAN AUTHORITIES

 

Further to our Complaint on 2 October 2006 (Ref: 393/2006) regarding the detention of four Southern Azerbaijani teenagers, we have now an update for your attention. These four teenagers were recently released and therefore we would like to thank Amnesty International for campaigning for their release, as per MDE 13/118/2006 on 11 October 2006. We would like also to thank you for any possible role that you might have played towards their release, although your confidential manner of the conduct of business suites keeps us in dark. However, our Complaint stands for the reasons explained below.

 

In this update, we would like to draw your attention to the Case of 15 years old boy, Mehemmed Riza  Evezpur. Following his release, it has come to light that he was actually traumatised as feared in our Complaint and he is now suffering from nightmares. The translation in Table 1 of the interview he has given to the Voice of America confirms this. With the benefit of the hindsight, our request for your fact-finding envoy regarding this case was not premature and could have saved these teenagers from trauma. The authorities have now resorted to a new technique by hampering his school registration. His family has come to the point of despair and do not know to whom they may complain. We believe the right authority in the circumstances is your good office, as you have mandates to ensure that the basic human right for education is implemented universally.

 

Further examination of our data on the detainees after the submission of our Complaint indicated that there is at least another Southern Azerbaijani teenager detained by the Iranian authorities. His name is Behruz ELIZADE and his basic details are presented in the Table 2 below, obtained from our research of published press cutting regarding him. His name was included in our past correspondences, e.g. our letters 391/2006 on 29 September 2006; 382/2006 on 17 September 2006 and 344/2006 on 28 June 2006. The table shows that he was arbitrarily detained three times in the last 6 months and it illustrates that the violations of his human rights have been most blatant. We are concerned about his safety in detention, as he is kept among known criminals. The remarks of the judge Mr. Elai are most revealing, as he regards this youngster a recurrent theme and vows to arrest him anytime as he wishes, see the Table 2. We are duly requesting for your kind attention for his immediate and unconditional release.

 

Our Complaint on the violation of human rights of these Southern Azerbaijani teenagers stands with updated details. We thank you in advance for an anticipation of your actions towards the maintenance of human rights of the above named Southern Azerbaijani teenagers.

THE RIGHT FOR EDUCATION HAS BEEN DENIED TO THE TEENAGER, MEHEMMEDRZA EVEZPUR, FOR PROMOTING HIS NATIONAL AZERBAIJANI IDENTITY

 

The Evezpur family is one of thousands of Southern Azerbaijani families that are suffering from illegal punishments imposed by the regime in Tehran for promoting their Azerbaijani identity.

 

One of the teenagers of this family is Mehemmedrza, who is just 15 years old and was arrested together with his two other brothers. He was detained under unimaginable conditions in the prison. Mehemmedrza was detained for 13 days in the Ministry of Intelligence Facilities in Tebriz. Here he was interrogated by security agents who regard it fun to torture both physically and mentally the persons in their custody.

 

Mehemmedrza regards his nightmare, the 9 days that he was kept in Tebriz Prison and when describing those days, he breaks in tears. He has lost his peace of mind and suffers from nightmares. He regards the chauvinism of the authorities as the only cause for his sufferings.

 

When giving an interview to the Voice of America and also when talking to an activist, Mehemmedrza also described his educational problems. His brother Murtuza said with a devastated voice that “My brother has been forbidden from education. Schools are refusing to register him. State officials are not responding and we do not know where to take our complaints.”

خانواده عوضپور يکي از هزاران خانواده آذربايجاني است که فقط و فقط به خاطر هويتخواهي٫ مشمول تحمل مجازات غير قانوني و غير انساني رژيم تهران ميشوند.

يکي از فرزندان نوجوان اين خانواده٫ محمد رضا که اکنون ۱۵ ساله است٫ به همراه دو برادر خود دستگير و تحت بدترين شرايط قابل تصور زنداني شده بود. محمد رضا ۱۳ روز در اطلاعات تبريز بازداشت بود. اداره اطلاعات و ماموران سخت دلي که تنها کارشان شکنجه است٫ روح و جسم زنداني برايشان مايه تفريح است.

۹ روز بعدي را که محمدرضا در زندان تبريز محبوس بود٫ بعنوان کابوس زندگي خود قلمداد ميکند و در حين شرح آنروزها اشک از چشمانش جاري ميشود. خواب از چشمانش ربوده شده و آرامش خود را از دست داده است. او٫ تنها باعث اين بدبختيها را سياستهاي شوونيستي ايران خواهد شناخت.

در مصاحبه با راديو صداي آمريکا و نيز در گفتگو با يکي از فعالين پرکار آذربايجاني٫ محمدرضا مشکل تحصيلي خود را نيز بيان ميکند. برادرش مرتضي با لحني پريشان ميگويد: “برادرم از ادامه تحصيل منع شده است. مدارس از نام نويسي او سرباز ميزنند. مقامات دولتي پاسخگو نيستند و ما نميدانيم به کجا شکايت کنيم”.

·      His family was unaware of the arrest and whereabouts of their child and extremely worried until they find out that their loved one is in prison without any indictment

·      After the arrest he resorts to hunger strike

·       The judge Mr. Elai gets angry when attending the case of this young boy and has threatened his family to issue a sentence of 100 lashes if he carries on with his activities on promoting the national identity of Azerbaijan. The authorities want him to undertake that he will stop his activities but Elirza pledges his support to the national cause of Azerbaijan

·      The judge says to his parents that “he has done nothing wrong but I keep him in the prison as he talks things too big for his mouth.”

·      The judge Mr. Elai has explicitly stated that he is playing a game with this young boy by keeping him in the prison

·      He was set free who received a heros welcome by other activists
