MÜRACİƏT İRANIN YETGİLİLƏRİ TƏRƏFİNDƏN GÜNEY AZƏRBAYCANLI FƏALLARINA QARŞI KƏSİLƏN ÖLÇÜSÜZ HÖKMLƏR - ŞİKAYƏT

İran yetgililəri tərəfindən Güney Azərbaycan fəallarına qarşı kəsilən hökmlərdə son gəlişmələri hüzurlarınıza təqdim edirik. Bunlar öz üzərilərinə almışlar ki, Azərbaycan mənliyini canlatsın, insan və milli haqlarımızı tələb etsin, və ana-dilimizin rəsmi statusunu yenidən dirçəltməsi üçün döyüşümüzü orkestrləşdirsinlər.

Fəallarımızın adları və onlara kəsilən hökmlər keçmiş aylarda yayımlanmış və biz sizi bu baxımdan bilgiləndirmişik. Bu məktubda biz sizə əlavə bilgi çatdırmaq istəyirik baxmayaraq ki, bunlar buraxılmış verilənlərin hamısına şamil deyildir. Bu hökmlərdən bir az baş çıxartmaq üçün, biz bunları bir cədvəldə toplaşdırmışıq. Bizim bilgi qaynaqlarımız daxildə olan öz qaynaqlarımızdan başqa ASMEK, UrmuNews, Haq vebbloqu, və South Azerbaijan News vebbloquna da istinad etmişdir. Tələbələrin dərslərdən asılqan olunmalarını biz bu hökmlərə daxil etməmişik.

Bu kəsilən hökmlər içrə sizin diqqətinizi aşağıdakı nüktələrə tuşlamaq istəyirik:

Hökmlərin qəddarlığı: misal üçün 65 yaşlı bəstəkara yaxud 3 yeniyetməyə də şallaq hökmü
Şallaq miqyası: 65 hökmdən 39-una şallaq var və bir fərdə kəsilən şallağın sayı 74 sayı qədər dəqiqdir.
Alçaltma: Bu şallaq hökmləri qəsdən dinc və zəkalı fərdlərin incə ruhlarına toxunmaq üçün quraşdırılmış

Cüz’ilik: Bəzi hökmlər o qədər əldən-düşmüşdür ki, tərəfsiz üçüncü şəxslər bu hökmlərin qarşısında dodaq büzməməkləri mümkün deyildir, misal üçün dövlət büdcəsi xeyrinə bir bilgi-sayarı zəbt etmək
Suçlar: Amnesty Internationala görə adətən bu suçlar hüquqi məhkəmələrdə tanımlı deyillər.

Biz inanırıq ki, kəsilən hökmlər göz görəki insan haqları prinsipinə qarşı meydan oxuyur. Bəlkə də bu zay qazılar orta-əsrlər sayağı ədavət açmaq qəsdindədirlər. Nə isə, onlar çağdaş insan haqları bəyaniyyəsinə olduqca yaddırlar. Ümumiyyət ilə hökmlərin icrası baxımdan biz bilgi qıtlığına məruzuq və buna görə fəallarımız uğrunda bütün bilgi əldə etməyə bilərik, lakin məsuliyyət hökumət boynundadır ki, dəqiq və güvenli statik verilənləri buraxsın.

İranının qazıları tərəfindən Güney Azərbaycanlı fəallarının insan haqlarını tapdamalarına qarşı şikayət edirik. Biz ümid edirik ki, siz öz diqqətinizlə gərəkən tədbiri seçəcəksiniz və bu addımları atacaqsınız: (i) İran yetgililərinin törətdikləri bilgi qıtlığına sərt yanaşacaqsınız; (ii) onların könülləri çəkdikləri kimi hökm buraxmalarına qarşı kəskin etiraz edəcəksiniz, və (iii) Güney Azərbaycanlı fəallarının insan və milli haqlarına sayğılı davranmalarını tələb edəcəksiniz. Dear sir/madam,

Re ARBITRARY SENTENCES GIVEN AGAINST SOUTHERN AZERBAIJANI ACTIVITTS BY IRANIAN AUTHORITIES – COMPLAINT

We would like to submit an update on the sentences passed since August 2006 by Iranian authorities against Southern Azerbaijani activists for promoting Azerbaijani identity, demanding our human and national rights and orchestrating the struggle for the reinstatement of the official status of our mother tongue.

The list of names and their associated sentences have been published over the last month or so and we have informed you of a number of them. In this letter we provide you with further information, although this is not exhaustive and we have not been able to trawl all the published information. In order to grasp the underlying information, we have integrated them in a tabular format. Our information sources derive from our own channels within Southern Azerbaijan and also include ASMEK, UrmuNews, the Haq webblog and the South Azerbaijan News webblog. Suspended students are not included in our integrated list.

We would like to draw your attention to the following issues:

Draconic nature of the sentences: e.g. sentencing a 65 years old composer or three teenagers to lashes
The scale of lashing: Out of 66 cases in our integrated data, 39 individuals have been issued with lashing. In once case, the number of lashes is 74, as if it was measured with precision
Humiliation: It seems that lashing is designed to humiliate these highly intelligent and peaceful individuals.
Disinformation: The authorities fail to release full information on the detainee, e.g. the sentences passed against 19 activists in Sulduz – no information was released other than “indicative” sentences
Triviality: Some of the sentences really raise the eyebrow of unbiased third parties, e.g. confiscating a personal computer in favour of the state revenue
Charges: According to Amnesty International, the charges are not normally recognisable in a court of law

We believe the sentences passed are all an unashamed challenge to the authority of human rights. Perhaps, the perpetrating judges seek medieval-style vengeance but are demonstrably alien to the modernity and the universal declaration of human rights. Normally, we do not know if the sentences are being carried out, thus we may not be able to provide you the full information but the onus is on the government to issue accurate and reliable statistics.

We raise our complaint against violations of human rights by Iranian judges against Southern Azerbaijani activists. We are hoping that you would be kindly deciding on the right approach to: (i) challenge the Iranian authorities against their disinformation on detainees, (ii) protest against their arbitrary acts, and (iii) demand a proper observation of human and national rights of Southern Azerbaijani activists.
